1. Agreement to these Terms

These Terms of Use (the "Terms") are a binding legal agreement between you and Celeste Van Dokkum, an individual residing in Connecticut, United States ("we", "us", or "our"), governing your use of the MemoryScroll application for iPhone (the "App") and the MemoryScroll website at camerascroll.fit (the "Site", and together with the App, the "Service").

By ticking the agreement box when you first open the App, or by otherwise using the Service, you acknowledge that you have read and understood these Terms and agree to be bound by them, together with the Privacy Policy, which is incorporated by reference. Terms defined in one document carry the same meaning in the other.

If you do not agree, do not use the Service and delete the App.

Sections 13 and 14 limit our liability to you, and section 16 governs how disputes between us are resolved. Please read them carefully.

2. Beta software

The App is distributed as a beta test through Apple TestFlight. It is pre-release software provided for evaluation. It will contain defects, features will change or disappear without notice, and content you post may be lost, including as a result of a server reset during testing. Do not rely on the Service to preserve anything. Section 13 applies with particular force to the beta.

3. Eligibility

You represent and warrant that:

  1. you are at least 13 years of age;
  2. if you are under the age of majority where you live, a parent or legal guardian has reviewed and accepted these Terms on your behalf and is responsible for your use of the Service;
  3. you are located in the United States, which is the only territory in which the Service is offered;
  4. you have not previously been removed from the Service; and
  5. you are not located in, or ordinarily resident in, a country subject to a comprehensive United States embargo, and do not appear on any United States government list of prohibited or restricted parties.

You confirm your date of birth when you create an account and the App will not continue if it works out to under 13. We do not verify age; that question is a gate, not proof, and we may remove any account we reasonably believe belongs to someone under 13.

4. What the Service is

On your device. The feed of your own camera roll, the analysis, the filters and the music selection all run locally. Browsing uploads nothing.

Online. Only what you choose to publish or send leaves your iPhone. Your account, your posts, your messages and your social connections are stored on our servers so that they reach the people you chose and your other devices. Section 2 of the Privacy Policy sets out the distinction in full.

The Service is not a backup service. It is not a substitute for iCloud Photos, the Photos application, or any other backup. Content can be lost through faults, mistakes, moderation, or account deletion. Keep your own copies of anything you care about.

Nothing you post is guaranteed to stay private. Anyone who can see a post can screenshot it, record it, or describe it. Treat anything you publish or send as capable of reaching more people than you intended.

Messages are not end-to-end encrypted. They are stored on our servers and are technically readable by us, in the narrow circumstances set out in section 9 of the Privacy Policy. Do not use MemoryScroll for anything you need to be confidential.

5. Your account

You are responsible for everything done through your account. Keep your password to yourself, use one account per person, and do not sell, share, rent or transfer an account. Your username, display name and profile picture are subject to section 7 and must not impersonate anyone. Sessions last up to 90 days. Tell us at memoryscrollsupport@gmail.com promptly if you believe your account has been used without your permission.

6. Your content

You keep ownership of everything you create and post.

Licence to us. So that we can operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, re-encode, compress, adapt for display, and transmit content you post, for the sole purpose of operating and supporting the Service — delivering it to the people you chose, displaying it in the App, generating thumbnails, and keeping it working. The licence includes no right to publish your content elsewhere, to license it to any third party, to use it in marketing, or to train machine-learning models on it, and we do none of those things.

The licence ends when you delete the content or your account, except for copies that may briefly remain in logs and anything we must retain under section 8 or by law.

Your promises about what you post. Each time you post, you represent and warrant that:

  1. you own the content or have every right and permission needed to share it, including rights to any music or other audio in it;
  2. everyone identifiable in it has consented to being recorded and shared where the law requires that; and
  3. sharing it breaks no law and no other agreement you are under.

Feedback. If you send us suggestions we may use them freely, with no obligation to you.

7. Rules of conduct

You may not use the Service to create, post, send, store or share:

Never, under any circumstances:

Also prohibited:

You also may not use bots, scrapers or crawlers; collect other people's content or personal data beyond ordinary use of the App; probe or test the security of the Service or bypass its limits, blocks, bans or privacy settings; reverse engineer, decompile or disassemble the App except where that right cannot be excluded by law; or resell, sublicense or commercially exploit the Service.

8. Safety tools, moderation, and how reports are handled

We do not pre-screen content and are not obliged to monitor the Service. You should know, however, that our moderation team can view any video, photo, post or message uploaded to our servers — including anything you send privately to a friend or in a chat — in order to keep the platform safe. Videos and photos you do not post or send stay on your device and cannot be viewed by us or anyone else. See the Privacy Policy, section 9. We act on what is reported to us, and we provide:

  1. a check before upload — Apple's on-device sensitive-content analysis, which refuses an item it flags so that it never leaves your device;
  2. a check on what you receive — the same analysis, run on your own device on media sent to you, with anything it flags hidden rather than shown;
  3. an automatic language filter that refuses slurs in captions, replies and messages, and which will not catch everything either;
  4. reporting a post or a message — hold any post, clip or message to report it - a post in the feed or on a profile, or a clip or message in a chat - choose a reason and, if you like, explain in your own words; a reported post disappears from your feed immediately, and a reported message is sent to us together with the few messages before it, so we can see what it was answering;
  5. reporting an account — the Report control on a person's profile, which lets you tell us that they are endangering or targeting a child, appear to be under 13, are posting sensitive or copyrighted material, or are breaking these Terms, and to explain in your own words;
  6. blocking, which ends the connection both ways and hides each of you from the other across posts, messages, search, suggestions and contact matching;
  7. your own controls — "hide me from discovery", deleting posts, and deleting your account; and
  8. notices — we may send a short notice to every account's notifications, for example about a security problem. The App can also notify your phone when a friend messages you, sends you a clip or a friend request, or likes your post; you can turn this off in iOS Settings.

Our response. We review every report as soon as we reasonably can, and reports about child safety or intimate images shared without consent first. A reported post may be taken out of view while it is reviewed. Reviewing a report may involve viewing the reported post and the other posts of the account that posted it, as described in section 9 of the Privacy Policy. We may then take no action, remove content, or warn, limit, suspend or permanently remove an account. A suspended account cannot sign in, and its posts and messages are hidden from everyone.

Intimate images shared without consent. If a nude or sexual image of you - real, or made or altered with AI - has been posted on the Service without your consent, you can ask us to remove it. In the App, hold the post and report it as Private images shared without consent. Or email memoryscrollsupport@gmail.com with: (a) your physical or electronic signature, or that of someone authorised to act for you; (b) where the image is - the account and post, and when you saw it; (c) a brief statement that you believe in good faith the image was posted without your consent; and (d) how we can contact you. We remove the image within 48 hours of receiving a valid request and make reasonable efforts to find and remove identical copies on the Service. This is our process under the federal TAKE IT DOWN Act.

Child safety. Sexual or exploitative content involving anyone under 18 is never allowed. Report it with Child safety. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children as the law requires, keep it out of everyone's sight and preserved for as long as the law requires, and remove the account. If a child is in immediate danger, call 911.

Reports that do not hold up. We keep a record of whether each report was upheld or dismissed. A report for copyright hides the post while it is reviewed, but not if the person reporting has had most of their earlier reports dismissed; and someone who keeps sending baseless reports can be suspended.

Our discretion. We may remove content or accounts, with or without notice, where we reasonably believe these Terms have been broken, where required by law, or where someone's safety is at risk. We may act on a lesser basis than a court would require. Enforcement is not always consistent, and taking no action in one case does not waive our right to act in another.

If you think we were wrong, write to memoryscrollsupport@gmail.com. We will look again and reply. There is no automated appeal process.

If you believe content on the Service infringes your copyright, send a notice to memoryscrollsupport@gmail.com including:

  1. your physical or electronic signature;
  2. identification of the work you say is infringed;
  3. identification of the material you say is infringing, with enough detail for us to find it — the post, the account, and when you saw it;
  4. your name, address, telephone number and email address;
  5. a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorised to act for the owner.

We will remove or disable access to material that is the subject of a valid notice, and tell the person who posted it, in the App. A post reported through the App is hidden from other people while we look at it. A post we take down is kept, not deleted, for 90 days.

Counter-notices. If you believe your post was taken down by mistake or misidentification, write to the same address with: your signature; what was taken down and where it was before; a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification; your name, address and telephone number; and a statement that you agree to the jurisdiction of the federal court for your address and will accept service from the person who sent the notice. We pass a counter-notice on to that person, with your contact details, and we put the post back not less than 10 and not more than 14 business days after we receive it, unless they tell us they have started a court action.

Repeat infringers. Each time we take a post down after a copyright notice, the account gets one strike; it is removed if the post is restored. An account with three strikes is suspended, and we may suspend one sooner for deliberate or serious infringement.

Notices we cannot take through the App - a signed notice, a counter-notice, or anything longer than the report box allows - go to memoryscrollsupport@gmail.com.

10. Third parties

11. Availability and changes to the Service

The Service is offered on an "as available" basis. It may be interrupted, and features may change, be limited, or be removed. We may impose limits on uploads, storage, posting, messaging, following and unfollowing. We may stop offering the Service; if we do, we will make reasonable efforts to give at least 30 days' notice through the App or the Site so that you can delete or preserve your content, except where an immediate stop is required by law or by a risk to someone's safety.

12. Ending your use

You may stop at any time. You may delete your account in Profile, then Settings, then Delete account. Deletion removes your posts and their media, clips you sent, your messages, circles, likes, hearts, follows, blocks and your profile. It cannot be undone. Deleting the App alone does not delete your account.

We may suspend or terminate your account, with or without notice, for breach of these Terms, for conduct that risks harm to others or to us, or where required by law.

Surviving sections. Sections 6 (as to content already delivered to others, to the extent needed to deliver it), 9, 13, 14, 15, 16, 17 and 18 survive termination, together with anything that by its nature should.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure or error-free; that content will be preserved, backed up or recoverable; that defects will be corrected; that the Service is free of harmful components; or that anything posted by another person is accurate, lawful or safe.

Other people. We are not responsible for the conduct of other users, online or offline, or for what they post. We do not vet or verify users. Use your own judgement about who you connect with and what you share.

Safety features are not guarantees. The on-device content checks depend on Apple's software and on a setting on your own device that can be switched off, and detect only certain kinds of imagery. The language filter, reporting and blocking likewise reduce harm without eliminating it. None of them is a substitute for your own judgement about what you post and whom you connect with.

Descriptive information is generated automatically. Place names, dates, categories, labels and scores shown in the App are produced on your device, are frequently inaccurate, and are for presentation only.

Some jurisdictions do not permit the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here removes rights you have as a consumer that cannot lawfully be removed.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF USE, OR LOSS, DELETION OR CORRUPTION OF DATA, PHOTOGRAPHS, VIDEOS OR MESSAGES, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICH FOR A FREE APPLICATION IS ZERO, AND ONE HUNDRED UNITED STATES DOLLARS.

These limits apply even if a limited remedy is found to have failed of its essential purpose.

Exceptions. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Some jurisdictions do not permit certain limitations, so parts of this section may not apply to you.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend and hold harmless Celeste Van Dokkum from and against any claim, demand, liability, damage, loss and reasonable legal cost arising out of or relating to: content you post; your use of the Service; your breach of these Terms; or your violation of any law or of anyone else's rights. We may assume the exclusive defence and control of any such matter, and you agree to cooperate.

16. Governing law and disputes

Talk to us first. Before starting any formal proceeding, email memoryscrollsupport@gmail.com describing the dispute and the relief you want. We will try in good faith to resolve it within 30 days.

Governing law. These Terms and any dispute arising out of them or out of the Service are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-laws principles.

Venue. Any action or proceeding arising out of these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of Connecticut, and each of us consents to the personal jurisdiction of those courts. This does not deprive you of the protection of any mandatory consumer-protection law of your state of residence, and neither of us is prevented from bringing an individual claim in a small-claims court with jurisdiction.

No arbitration or class waiver. These Terms contain no agreement to arbitrate and no waiver of your right to take part in a class or representative action.

Limitation period. To the fullest extent permitted by law, any claim relating to the Service must be commenced within one year after the cause of action accrues.

Equitable relief. Nothing here prevents either party from seeking injunctive relief in a court of competent jurisdiction concerning the misuse of intellectual property.

17. Provisions required by Apple

You and we acknowledge the following, required for an application distributed through the App Store and TestFlight:

  1. these Terms are concluded between you and us only, not with Apple, and we alone are responsible for the App and its content;
  2. the licence to use the App is a non-transferable licence to use it on an Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
  3. Apple has no obligation to furnish any maintenance or support for the App;
  4. if the App fails to conform to any applicable warranty you may notify Apple, and Apple may refund the purchase price, which for a free application is zero; to the maximum extent permitted by law Apple has no other warranty obligation;
  5. we, and not Apple, are responsible for addressing any claim by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection legislation;
  6. we, and not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that the App infringes intellectual property rights;
  7. you represent that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and are not on any United States government list of prohibited or restricted parties;
  8. you must comply with any applicable third-party terms when using the App; and
  9. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. General

Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.

Amendment. We may amend these Terms. Where an amendment is material we will update the effective date and version above, publish the amended Terms on the Site, and present them in the App on next launch. Continuing to use the Service after an amendment takes effect means you accept it; if you do not, delete your account.

Export and government users. You must comply with all applicable export control laws. The App uses only cryptographic functionality provided by Apple's operating system, together with standard hashing, and incorporates no cryptography of our own. If you are a United States Government end user, the App is "commercial computer software" provided with only those rights granted to all other users.

Severability. If any provision is unenforceable, it is enforced to the maximum extent permissible and the rest stands.

No waiver. Not enforcing something once does not waive it.

Assignment. You may not assign these Terms. We may assign them to a successor.

Force majeure. We are not liable for delays or failures caused by events outside our reasonable control.

Notices. Email is the notice channel under these Terms. Send anything you need us to receive to memoryscrollsupport@gmail.com; we may reach you through the App, the TestFlight listing, or the Site.

Electronic communications. You consent to receive communications from us electronically, and agree that any such communication satisfies a legal requirement that a communication be in writing.

No third-party beneficiaries. Except as stated in section 17(i) for Apple, these Terms confer no right on any third party.

Headings are for convenience only. Language: these Terms are written in English and the English version governs.
